Terms and Conditions

1. Scope and Applicability

These Terms and Conditions govern the professional legal relationship between LawForAge and our senior clients. They form an integral part of all contracts regarding our elder legal services, senior law consultations, and related professional services. By engaging or using our legal services, the client fully accepts these Terms and Conditions and commits to following the professional standards they represent.

2. Contract Formation and Scope of Services

A legal service contract with LawForAge is formed either through mutual signing of a written retainer agreement or through our written confirmation of a client's engagement. The exact scope of legal services, objectives, timeframe, and fees are defined in individual retainer agreements or engagement confirmations. Changes or additions require written form and mutual agreement.

3. Service Offerings

Our senior legal service offerings include but are not limited to:

  • Estate planning and will creation
  • Retirement and pension planning
  • Healthcare directives and guardian rights
  • Family mediation and elder rights protection
  • Senior housing and care law
  • Tax planning for seniors
  • Elder law compliance and rights protection

4. Legal Fees and Payment Terms

Our legal fees are stated in Swiss Francs (CHF) and are subject to applicable taxes including VAT. For complex matters, we reserve the right to issue payment plans. Unless otherwise agreed, the following payment terms apply:

  • Estate planning services: 50% retainer upon engagement, balance upon completion
  • Legal consultations and advisory services: Payment within 30 days of invoice
  • Ongoing legal matters: Monthly billing with a payment term of 30 days
  • Court proceedings and mediation: Retainer required with regular billing

5. Refund Policy

LawForAge is committed to providing exceptional legal services and maintaining transparent refund policies. Our refund policy reflects our understanding that senior legal matters require careful professional handling:

  • Service Cancellation by LawForAge: If we are unable to provide legal services for any reason within our control, clients will receive a full refund of unused retainer fees.
  • Client Withdrawal Prior to Service Commencement:
    • More than 7 days before scheduled service start: Full refund minus a CHF 150 administrative fee
    • 3-7 days before service start: 80% refund of unused retainer
    • Less than 3 days before service start: 60% refund of unused retainer
  • Client Withdrawal After Service Commencement:
    • Refund calculated based on unbilled time and expenses from retainer
    • All work completed to date will be billed at standard rates
    • File transfer and documentation fees may apply
  • Special Circumstances: In cases of serious illness, family emergencies, or other extraordinary circumstances preventing completion of legal services, we will consider compassionate adjustments on a case-by-case basis with appropriate documentation.

All refund requests must be submitted in writing to seniors@LawForAge.com. Refunds will be processed within 15 business days and issued using the original payment method. We understand the importance of legal service investment and handle all refund requests with care and professionalism.

6. Appointment Scheduling and Cancellation Conditions

Scheduled legal consultations and client meetings are important professional commitments. For cancellations or rescheduling by the client, the following guidelines apply:

  • Cancellation up to 48 hours before the appointment: free rescheduling
  • Cancellation 24-48 hours before the appointment: 50% of the consultation fee
  • Cancellation less than 24 hours before the appointment: 75% of the consultation fee
  • No-show without notification: 100% of the consultation fee

In exceptional circumstances (such as serious illness with documentation), we strive for accommodating solutions. EstateLawHelpUp reserves the right to reschedule appointments for important legal reasons. In this case, the client will not incur any costs.

7. Client Cooperation and Responsibilities

The success of our legal representation depends significantly on the client's cooperation and timely provision of information. The client therefore commits to:

  • Provide all information necessary for legal representation completely and truthfully
  • Respond promptly to requests for documentation and information
  • For corporate clients: ensure authorized representatives have decision-making authority
  • Provide feedback to enable effective legal representation
  • Maintain confidentiality regarding legal strategies and sensitive information

8. Confidentiality and Professional Privilege

EstateLawHelpUp is committed to the highest level of confidentiality regarding all client information and legal matters. This solicitor-client privilege applies indefinitely beyond the termination of our legal relationship. We treat all client information with the deepest respect and do not share it with third parties without express consent or legal obligation. The collection and processing of personal data takes place in accordance with our Privacy Policy and applicable data protection regulations.

9. Legal Documents and Property Rights

All legal documents, research, and materials created by EstateLawHelpUp remain the property of the client upon full payment of fees. The client receives full ownership rights to all work product created specifically for their legal matter. EstateLawHelpUp retains the right to maintain copies for professional records and potential future reference. Sharing of client documents or legal strategies with others requires express written consent from the client.

10. Testimonials and Case References

EstateLawHelpUp values client testimonials and success stories, but respects client privacy above all. The use of client names, case details, or specific outcomes for marketing purposes always requires express written consent from the client. At the client's request, specific confidentiality agreements can be made to regulate this point in more detail. Professional references may be provided with client permission.

11. Liability and Legal Disclaimer

EstateLawHelpUp provides legal services with the utmost care and to the best of our professional knowledge and expertise. However, we cannot guarantee specific legal outcomes, as legal matters are influenced by many factors including court decisions, opposing parties, and changing laws. Our liability is limited to professional negligence and malpractice as governed by the Law Society of Ontario regulations. Professional liability insurance is maintained as required by professional standards.

12. Term and Engagement Completion

For ongoing legal relationships, the term and termination procedures are based on individual retainer agreements. Unless otherwise agreed, either party may terminate the relationship with reasonable written notice. Both parties reserve the right to terminate the relationship for important professional reasons. Termination requires written form and professional acknowledgment of file transfer procedures.

13. Final Provisions

Should individual provisions of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. An effective provision that comes closest to the legal purpose of the invalid provision shall replace the invalid provision. Changes or additions to these Terms and Conditions must be in writing. Ontario and Canadian law applies exclusively. The place of jurisdiction is Toronto, Ontario, insofar as legally permissible.
